1. Introduction

Welcome to Kuditrak! These Terms and Conditions ("Terms") govern your use of the Kuditrak mobile application and website (collectively, the "Service"). By accessing or using Kuditrak, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Definitions

- "Kuditrak," "we," "our," or "us" refers to the Kuditrak platform and its operators.

- "User," "you," or "your" refers to any individual or entity accessing Kuditrak.

- "Services" refers to the financial tracking, budgeting, and bank connection functionalities provided by Kuditrak.

- "Subscription" refers to the auto-renewing premium plans offered through Apple App Store and Google Play Store.

3. User Eligibility

You must be at least 18 years old or have legal guardian consent to use Kuditrak. By using our services, you confirm that you meet these eligibility requirements.

4. Account Registration and Security

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and agree not to share them with anyone. You are responsible for all activities that occur under your account.

5. Account Deletion

You may delete your account at any time by navigating to: Profile → Settings → Delete Account. Account deletion is permanent and will remove all your personal data, transaction history, budgets, and connected bank accounts from our servers. This action cannot be undone.

Upon account deletion, your subscription will not be automatically cancelled. You must cancel your subscription through your Apple ID or Google Play Store settings separately.

6. Subscriptions and Auto-Renewal

Subscription Plans:

• Basic Monthly: ₦1,900/month - 3 bank connections, 10 budgets, 50 manual transactions
• Pro Monthly: ₦3,900/month - Unlimited features, priority support
• Pro Quarterly: ₦9,900/quarter - Save 15% vs monthly
• Pro Yearly: ₦33,900/year - Save 25% vs monthly + annual review

Auto-Renewal: All subscriptions are auto-renewing. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.

Cancellation: You may cancel your subscription at any time through your Apple ID settings (for iOS) or Google Play Store settings (for Android). Cancellation will take effect at the end of the current billing cycle.

Price Changes: We reserve the right to change subscription prices. Price changes will be communicated to you and will take effect at the next renewal date.

Refunds: All purchases are processed by Apple and Google. Refund requests must be submitted to Apple or Google directly. Kuditrak does not process refunds directly.

7. Bank Connection (Mono API)

Kuditrak uses Mono, a CBN-licensed Open Banking provider in Nigeria, to connect to your bank accounts.

How it works: When you connect a bank account, you are redirected to Mono's secure portal. You authenticate directly with your bank. Kuditrak receives an encrypted token to access transaction data. We never store your banking credentials.

Read-Only Access: Kuditrak has read-only access to your transaction history. We cannot initiate transfers, make payments, or modify your account in any way.

Disconnection: You may disconnect your bank accounts at any time by tapping the trash icon on the account card. This removes the connection from Kuditrak but does not delete your data from Mono.

8. User Responsibilities and Prohibited Conduct

- You agree to provide accurate and up-to-date information.

- You will not use Kuditrak for any illegal or unauthorized purposes.

- You will not attempt to disrupt the service or compromise security.

- You will not share your account credentials with others.

- You will not use the service for money laundering or any financial crime.

9. Financial Disclaimer

Kuditrak provides financial tracking and budgeting tools but does not offer professional financial, tax, or legal advice. The information provided is for informational purposes only. Users should consult qualified financial professionals before making financial decisions.

Kuditrak is not a bank or financial institution. We do not hold user funds or process payments. All payments are processed through Apple App Store and Google Play Store.

10. Intellectual Property

All content, logos, trademarks, and code associated with Kuditrak are our intellectual property and may not be copied, modified, distributed, or reverse-engineered without our explicit written permission.

11. Limitation of Liability

To the fullest extent permitted by law, Kuditrak and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of data, financial losses, or unauthorized access to your accounts.

Kuditrak is provided "as is" without warranties of any kind, either express or implied.

12. Termination of Account

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activities, misuse our services, or violate applicable laws. You may also terminate your account at any time as described in Section 5.

13. Third-Party Services

Kuditrak integrates with third-party services including:

• Mono: For bank account connections
• RevenueCat: For subscription management
• Paystack: For wallet top-ups
• Apple App Store & Google Play: For payment processing

These third parties have their own terms and privacy policies. Kuditrak is not responsible for their practices.

14. Data Privacy

15. Changes to Terms

We may update these Terms from time to time. Continued use of Kuditrak after changes are posted constitutes acceptance of the revised Terms. We will notify users of material changes via email or in-app notification.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.
